Frederic A. Ogg, a resident of the city of Madison, died testate on October 23, 1951. The petition for probate of the will
of the deceased estimated the gross value of the estate at $250,000, but counsel in their oral arguments before this court
stated that the value of the estate is considerably in excess of such estimate. The last will of the deceased was dated April
18, 1951. It is a fairly lengthy and well-thought out document containing many bequests (some outright and some by way of
trust) to various friends and former employees; gifts to various religious, charitable, and educational organizations; and
trusts for scholarships at both Indiana University and the University of Wisconsin. The only next of kin of the deceased is
his sister, Grace L. Ogg. The provision in the will for such sister was the creation of a trust, whereby she was to be paid
$250 monthly so long as she should live, with power in the personal representative or trustee to increase such monthly payments
if they proved insufficient to take care of her needs adequately. In addition, she was given the right to select some of the
articles of furniture and furnishings in the home of the deceased. The will named the First National Bank of Madison, as trustee, but no executor was named. Paragraph Ninth of the will, however,
contained the following provision:
